ADA Claimants Must Be Qualified for Swim Programs
To establish a claim for
discrimination on the basis of disability under the Americans with Disabilities
Act (ADA), an individual must establish that he/she is still otherwise
qualified to perform the essential functions of a position or program, with or without
reasonable accommodations. Under the ADA, requested accommodations would not be
considered reasonable if requested modifications would effect a fundamental
change in the essential functions of a position or program.
